Acceptance of Terms

By creating an account or using the Pocket platform, you agree to these Terms of Service. If you do not agree, do not use our services.

These terms apply to all users including restaurant owners, managers, staff members, and end customers.

Description of Service

Pocket provides a cloud-based point of sale, QR ordering, kitchen display, and restaurant management platform, accessible via web browser and mobile apps.

We offer tiered subscription plans with different feature sets and user/table limits. We reserve the right to modify, suspend, or discontinue any part of the service with reasonable advance notice.

Accounts & Responsibilities

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must not share your login with unauthorized users.

You agree to provide accurate business information and to use the platform only for lawful purposes in compliance with applicable laws including tax and fiscal regulations in Macedonia.

Subscription & Billing

Subscriptions are billed monthly or annually via Halkbank Open Banking (PIS). All prices are in Macedonian Denar (МКД) and include 18% VAT.

You may cancel your subscription at any time; access continues until the end of the current billing period — no partial refunds for unused time.

We reserve the right to change prices with 30 days advance notice. The 14-day free trial requires no payment method. After the trial expires, a paid subscription is required to continue using the service.

Your Data

You retain full ownership of all data you enter into the platform — menus, orders, staff records, customer information, and financial data.

We process this data solely to provide the service. Upon account closure, you may export your data. We will delete your data within 90 days of closure, subject to legal retention requirements.

Acceptable Use

You may not use Pocket to:

• Violate any applicable law or regulation • Process fraudulent transactions or engage in money laundering • Attempt to gain unauthorized access to our systems or other users' accounts • Reverse-engineer, decompile, or copy any part of the platform • Transmit malware, spam, or harmful content • Use the service in a way that could damage, disable, or impair our infrastructure

Violation of these restrictions may result in immediate account suspension or termination without refund.

Intellectual Property

All content, code, design, and features of the Pocket platform are owned by Pocket POS and protected by intellectual property law. You receive a limited, non-exclusive, non-transferable license to use the platform for the duration of your active subscription.

You may not copy, reproduce, or create derivative works from the platform without our written consent.

Limitation of Liability

The Pocket platform is provided "as is". We strive for high availability but do not guarantee uninterrupted or error-free service.

To the maximum extent permitted by applicable law, our total liability for any claim arising from your use of the service is limited to the amount you paid us in the 3 months preceding the claim.

We are not liable for indirect, consequential, incidental, punitive, or special damages, including loss of revenue, data, or business opportunities.

Governing Law & Disputes

These Terms are governed by the laws of the Republic of Macedonia. Any disputes arising from these Terms or your use of the service shall be submitted to the competent courts in Skopje, Macedonia.

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
